Terms and Conditions for lending image data

1. All our artworks (hereinafter referred to as the "image") are for lending only (including CD-ROMs and other digital data). The image does not pass into the customer's (hereinafter referred to as the "user") possession but remains in the ownership of the Ernst Barlach Lizenzverwaltung Ratzeburg.

2. Image material can be loaned for up to 8 weeks if no other arrangement is made.

3. The user purchases the right for an assigned and specified single use of the image. Any kind of usage beyond that, especially for commercial or promotional purposes - and the publication in the Internet/Intranet whether for private, educational, or commercial reasons - is subject to our permission and liable to charges. Any transfer to third parties is prohibited.

4. Manipulation, such as copying by hand, by photographic means, photocomposing, colouration, or electronic media is not allowed.

5. Maximum resolution of 72 dpi is not be exceeded when using images for websites. Digital presentations are not to offer any facility for downloading or copying.

6. When returning image material, all copies - including digital ones - of the image recorded in the user's archives, electronic archives, and data media are to be deleted, regardless of whether the image was used or not. All possible duplicates and copies made in the work process are to be deleted after use.

7. Pricing is according to fees customary to the market. Charges are as per our latest tariffs which are available on request.

8. All images are to be returned undamaged and in origin by the end of 6 weeks. Compensation is to be paid for damage or loss. Compensation payments amount to 50.00 € per monochrome, 100.00 € per colour photo, and 120.00 € per CD-ROM. Compensation in the amount of five times the original lending fee will be charged if an image is recorded in archives or illicitly transferred to third parties. (We reserve any additional compensation based on the copyright to the work by Ernst Barlach in cases of illicit recording, publication, or transfer of images.)

9. Any unauthorized prolongation of the loan period will be charged with 1.00 € per image per day (digital images are excepted).

10. Our credit line © Ernst Barlach Lizenzverwaltung Ratzeburg is to be mentioned. Omission of this credit line will cause an extra charge of 100% on the original lending fee.

11. The user agrees to automatically send two specimen copies of his/her publication to our office.

12. The purchase or use of our images signifies our users' acceptance of these terms.

13. This English contract is a translation. In the event of any dispute, the contract having precedence is the original contract in German.
